Can An Employee With Migraines Use Fmla
One very important thing employers should note is that the;Family and Medical Leave Act can be used by migraine sufferers.;FMLA allows certain employees to take up to 12 weeks of unpaid leave in a 12 month period for a serious health condition, including a migraine.
If you have an employee with migraines who is taking a lot of time off, they should consider getting onto FMLA.;This protects their employment status as well as their health insurance benefits. Employees can take the 12 weeks of unpaid leave all at once or broken up into smaller chunks of time, and they dont have to use it all. For employees missing work due to migraines, they are more likely to end up taking a day here or there as needed.
Family Emergency To Call Off Work

Here’s How To Talk To Your Boss About Your Migraine Headaches
After conducting a survey among migraine sufferers we found that, for the almost 1,000 people who took our survey, the average pain rating during a migraine is 7.4 . So, pretty darn agonizing.
âSometimes,â survey respondent and Cove customer America M. says, âitâs too much pain to handle leaving the house. Not only can my head throb for several hours, but I become very dizzy and not focused. Iâm also very nauseated and my body just feels terrible.â
Dealing with that type of pain is hard enough on its own. But pushing through it when you also have to work? Thatâs a doozy. Given how incapacitating migraines can be, itâs no surprise that they can have a major impact on your ability to do your job. And we donât believe you should be penalized for something that isnât your fault.
If you work for someone else, itâs a good idea to have an open, honest conversation with your boss to see if you can develop a plan that helps you be the most productive and healthy employee possible.
And because 60% of sufferers who took the survey do not talk to their manager about their migraine attacks, we wanted to emphasize that you absolutely have the right to advocate for yourself and your health at work.
So, here are some tips on how to go about this conversation .
Use Believable Sick Day Excuses Sick At Work
You do not have to give elaborate explanations when taking a sick day at work. Use plausible sick day excuses when you want to call in sick. You do not have to share all details with your colleagues or boss. Be polite and professional, but you are not obliged to answer any follow-up questions if you are uncomfortable.

To Talk Or Not To Talk
Generally, it’s a good idea to keep your personal life separate from work life.
But if you’ve tried to quietly remove migraine triggers from work, and it’s not working — or if you find yourself having to leave the office frequently because migraine symptoms are interfering with your job performance, it may be time to let your boss and/or co-workers know about your migraines.
And keep in mind your upcoming job performance review. If migraines cause the quality of your work to suffer but your supervisor doesn’t know about your condition, your performance evaluations can take a hit. “If you didn’t ask for an accommodation before, that’s the wrong time to ask for it,” Reisinger says.
Ultimately, it’s your decision to disclose, or not. If you do decide to discuss a medical condition at work, Reisinger says, the approach you take matters.
If it’s obvious that you’re dealing with something personal at work — say you have to wear sunglasses indoors to reduce the effects of bright office lights — it’s important to avoid telling only some people around the office and not others. “If you tell only some people, it starts to look like you’re playing favorites,” Reisinger says.
And limit what you share. No one needs to hear about how often your migraines cause you to vomit, for example. “Keep it light, and don’t try to get people to feel sorry for you,” Reisinger says.
Your employer’s Human Resources department is another place to turn for help if specialized programs aren’t in place.
It Keeps Happening: My Third Episode
After a major depression and high anxiety episodes that followed, with help, I got back on my feet and found a new job. I chose again not to disclose anything about my mental health. When feeling highly stressed and less able to focus, I would tell my boss I was going through some personal stuff. I would take a sick day occasionally if needed. Due to the work environment , I felt the risks were outweighing the gains of disclosing any further details. My symptoms werent present all of the time nor unmanageable. I was performing. Thanks to awareness and mindfulness! I must confess that I did open up to a few trusted colleagues who I thought were themselves at risk of mental health issues due to work-related stress.;;

Identify Your Migraine Triggers And Avoid Them
While thereâs no cure for migraine, there are likely certain things that trigger your attacks. If you havenât identified yours yet, start tracking your migraine attacks and see if there are any trends. Some common triggers are:
- bright lights,
Once you have a list of specific-to-you triggers, see which of them are in your workplace. And when you go to talk to your boss, take your trigger list in with you, along with some accommodation suggestions. Explain that decreasing your exposure to triggers lessens the likelihood of getting a migraine, which, in turn, means you can be as productive as usual.
For instance, maybe a trigger is noise, and your desk is right next to a common area. Or, maybe scent is one, and you work next to a person who wears way too much cologne. In addition, you may be able to get rid of some triggers on your own. If dehydration is a big one for you, you can make sure to take a large water bottle. Others, though, are in the control of your workplace.
No matter how many accommodations you and your boss may put in place, though, you may still get a migraine at work. Be prepared for the possibility. Keep some of your acute medications at your desk and devise a plan of action. Perhaps thereâs a dark, quiet room you can duck into for a bit. Or maybe you can rest in your car with some noise-canceling headphones and sunglasses.
You Can Decide How Much You Want To Share
If you decide to disclose your migraine disease to your employer you must then decide how much information to share. Some people are more comfortable being a bit vague and simply stating they have a type of condition , while others are more comfortable saying exactly what they have .
Disclosing your health status can be a great opportunity to provide some basic education to your employer about the nature of your disease so your superiors can better understand what you’re dealing with. But doing so can be a huge risk.
Have any of you dealt with this? How did you handle it? Did you make the right decision?

When A Migraine Strikes At Work
Rosen says studies suggest that when a migraine strikes, taking medication as soon as the pain starts can help to prevent a headache from getting out of control. So be prepared.
“In general, I would recommend headache sufferers keep all of their non-sedating medications at work,” Rosen says. This includes anti-inflammatory and migraine-specific medications.
If possible, retreat to a break room or a quiet space while you’re waiting for the medication to start working.
Just keep the heavy stuff at home, Rosen advises. Narcotic pain relievers and some anti-nausea medications can be quite sedating. And any new medication should always be tried first at home, so you know how you react to it.

Can You Say Youre Feeling Tired As An Excuse To Miss Work
While more and more companies are accepting the idea of a mental health day without a specific reason or emergency, this excuse is best if requested one or two days in advance.
General tiredness isnt one of the best reasons for missing work on the day of your shift, since itll leave your boss wondering why you didnt plan ahead and communicate better.
Ive had horrible jobs myself, and I understand having a feeling of panic in the morning when youre simply overwhelmed and want to call out. However, I recommend using one of the excuses above if youre going to call out of work last minute.
Its better to take a sick day than a mental health day if giving short notice.
Save the personal day or mental health day for when youre able to request it at least one or two days in advance.
Don’t I Have To Tell The Boss
But how, you might wonder, can you get the time off and the adjustments you need without telling your boss you have cancer?
For most people, it’s the side effects of treatment, not the cancer itself, that keep you from working. It’s chemotherapy-related pain or grogginess that might make it hard to do your job the way you usually do. You may choose to tell your employer about these symptoms rather than your diagnosis. For example, “I need medical treatment that will require me to take time off.”
You and a health care provider will fill out a few forms for your leave and accommodations. It’s important to know that your employer might give you a company-based form that asks for a diagnosis, but federal forms don’t ask that.
“Some health care professionals will only fill out the Department of Labor form, so they’re only sharing information that the employer is legally entitled to,” says Bryant.
The federal form simply requires certification from a health care provider that you have a medical reason to request leave. If you don’t want to share your diagnosis, tell your provider before you complete the forms. That way, the provider will omit your diagnosis from the paperwork and avoid words such as chemotherapy and oncology.
“One sticking point is where the form asks for your provider’s specialty,” says Bryant. “If you don’t want to disclose, the provider can write ‘internal medicine’ rather than ‘oncology.’ It’s absolutely true without inadvertently disclosing.”

What Are Your Rights
If your employer has at least 50 employees, the organization must follow a law called the Family Medical Leave Act. The law gives employees who are seriously ill 12 workweeks of leave during a 12-month period. If you’ve been at your job at least 12 months in the last 7 years, and you’ve worked the equivalent of about 24 hours a week per year, you’re probably eligible. Leave can give you the time you need for treatment, including surgery, recovery, and chemotherapy.
But you might need more than time off to help you through treatment. The Americans with Disabilities Act makes sure that organizations with at least 15 employees help make the adjustments employees need to do their job during and after a serious illness.
“Not enough people know about reasonable accommodations and utilize them to their full benefit,” says Bryant. “They’re one of the most important tools for individuals to either work through treatments or to return to work after treatment.”
Reasonable accommodations, as the ADA calls them, are exactly that: accommodations, as long as they are within reason, that will help you do your job when you’re sick. The things you might need depend on many things. A big factor is what kinds of side effects you have from treatment, such as fatigue, nausea, pain, or trouble thinking clearly. You won’t know what accommodations would help you until you need them. And, that may change over time.
